1. Subject Matter of the Contract
Amici Caffè AG shall sell to the customer (hereinafter referred to as “Customer”) the goods described in the hardcopy catalogue and the online shop under the terms of delivery and sale (GTCS) set forth herein. Products ordered from the e-shop shall only be used for private purposes and consumption. Any use for commercial purposes is prohibited.
2. Conclusion of the Contract
By placing an order, the Customer accepts the General Terms and Conditions of Sale (GTCS) detailed in the hardcopy catalogue or the online shop. The contract between the Customer and Amici Caffè AG shall be considered concluded when the Customer has placed an order and Amici Caffè AG has accepted it as follows: the order may be placed by telephone, mail, fax, email or through the online shop. Amici Caffè AG accepts the order by delivering the ordered goods to the Customer, complete with invoice/delivery note, in compliance with the terms of payment and delivery set forth in Articles 4 and 5 hereof.
3. Product Range
Product information acquired by the Customer from the product catalogue is not binding. In particular, we reserve the right to introduce design and technical changes aimed at improving the functionality of a product, or in case of errors in product description, illustration or price. The prices indicated are valid for the current period. We reserve the right to make price adjustments from time to time.
4. Terms of Delivery
The ordered products can be shipped only to addresses in Switzerland and the Principality of Liechtenstein. If on stock, the products are shipped immediately to the address indicated by the Customer. Goods are shipped at the Customer’s risk and expense, also in case of partial deliveries.
Free shipping for orders of CHF 200.00 or more.
5. Terms of Payment
The prices on the catalogue are indicative and are constantly adapted to market conditions. Prices are in Swiss Francs (CHF) VAT included and include the mandatory advanced recycling fee. Shipping and packaging costs are charged separately. Generally, payment must be made within 30 days from the invoice date. Any delay in payment shall result in the blocking of the Customer’s account. An administrative fee of 10.00 CHF may be charged starting from the second payment reminder. To make purchases, new customers are required to pay by credit card, advance payment or in cash. Amici Caffè AG reserves the right to make deliveries even to existing customers only against payment by credit card, advance payment or cash on delivery.
6. Retention of Title
Amici Caffè AG shall retain title of the goods supplied until all amounts owed are fully paid. Amici Caffè AG shall be entitled to make an entry in the retention of title register. In case of delay in payment of the sale price by the Customer, Amici Caffè AG shall be entitled to terminate the contract (termination statement) and collect the goods in the Customer’s possession.
7. Warranty and Liability
The guarantee for all electrical devices is 24 months from the date of purchase, unless a different guarantee period has been expressly agreed in writing. During this warranty period, we undertake to repair, free of charge, any defects or defects that arise due to material or manufacturing defects (Amici's right to repair). The guarantee expires if the machine is opened independently or if changes or repairs are made to the goods. A reduction or change is expressly excluded. In particular, Amici Caffè AG is not liable for damage that is due to improper use or natural wear and tear or for damage that did not arise from the delivery item itself (consequential damage). If there is externally visible damage to the ordered goods, damage settlement will only take place upon receipt of a certificate from the respective transport company. The buyer is obliged to inform us immediately of any defects or defects and to obtain our written consent before engaging third-party companies or carrying out their own intervention. If a repair is carried out by an unauthorized service provider and this results in further defects or damage, any warranty claim will be void. Repairs carried out outside of this warranty period will not result in an extension or restart of the original warranty period.
8. Intellectual Property
Amici Caffè AG reserves all rights to any design, text or graphics present on its printed material or available online. Copying or any other form of reproduction, either total or partial, of the foregoing materials is permitted only for the purpose of placing an order with Amici Caffè AG. The name Amici Caffè AG, all page headings, navigation bars, graphics and icons are deposited or protected Amici Caffè AG commercial marks. All other marks, names of products or of companies, and logos appearing on printed material or online are the exclusive property of their respective owners. Amici Caffè AG retains ownership rights and copyright to images, drawings, calculations and other documents. The Customer shall not transfer them to third parties without the prior written consent of Amici Caffè AG.
9. Data Protection
Amici Caffè AG warrants compliance with the Swiss privacy law and the relative applicable regulations when collecting, processing and using personal data. Customer data required to carry out the order are only used internally for statistical purposes. Data shall be transmitted to third-party collaborating companies only if strictly necessary for the purpose of performing the required activity (carrying out the order). We reserve the right to make our payment experiences available to an information pool. The Customer consents to such use of its data. Amici Caffè AG reserves the right to send by email to the Customer information on Amici Caffè AG, and its news and updates.
10. Place of Jurisdiction and Applicable Law
These GTCS and the contracts concluded under these GTCS are governed by Swiss law. The place of jurisdiction shall be the same as the headquarters of Amici Caffè AG.
11. Final Provisions
For the sale of the goods offered on the Amici Caffè AG hard copy catalogue or e-shop, the only applicable GTCS are those in force at the time of conclusion of the contract. These terms and conditions of sale shall prevail over the GTCS of the Customer, if any. Should any provisions of these GTCS be or become inapplicable, the validity of the remaining provisions shall remain unaffected. Amici Caffè AG reserves the right to change these General Terms and Conditions of Sale at any time.
